Arbitration
Arbitration is an effective technique for resolving disputes - whether personal
injury matters or divorce - outside the courts. Many contracts between
employers and employees or between vendors and buyers now include
arbitration clauses, which mandate that disputes be resolved by
arbitration (thereby precluding protracted litigation in the courts).
In
an arbitration, the parties refer their dispute to one or more people
(the "arbitrators") by whose decision (the "award") they agree to be
bound. The third party's decision of the case imposes a decision that
is legally binding
for both sides.
